15240 (3 0 1. � 4 ORDINANCE NO. 1524 (#4 — 2015) AN ORDINANCE CREATING JMC § 3.08.065 (PURCHASES THROUGH ARKANSAS HIGHWAY& TRANSPORTATION DEPARTMENT'S BIDDING PROCESS); DECLARING AN EMERGENCY; AND, FOR OTHER PURPOSES. WHEREAS, much of the process of securing appropriate bids and costs factors for the purchase of personal property items, equipment, and/or materials bought and/or utilized by the City of Jacksonville, the Jacksonville Wastewater Utility, and the Jacksonville Water Department involves time, additional costs, and staff efforts to secure a low cost options for the purchase of said property, equipment, and materials; and, WHEREAS, as an alternative to purchase said property, equipment, and materials in a cost effective manner and securing low costs, staff recommends purchasing such items utilizing the Arkansas Highway & Transportation Department's bids when available and comparable to the property, equipment, and/or materials sought. Doing so will be similar in process to purchasing through the State's bidding process, as authorized by JMC § 3.08.060, and will allow the City, JWU, and JWW to save funds, time, and efforts while acquiring needed property, equipment, and materials at reasonable cost. BELT ORDAINED AND ENACTED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS; SECTION RKANSAS.- SECTION ONE; Jacksonville Municipal Code § 3.08.065 (Purchases Through AHTD Bidding Process) is hereby created and shall read as follows: (A) Authority. The City of Jacksonville, the Jacksonville Wastewater Utility, and the Jacksonville Water Works, together with their various departments, entities, and authorized representatives, are hereby granted authority to participate in and purchase, if such is determined to be feasible and efficient, any and all appropriate supplies, services, equipment, and/or materials through bids properly solicited and received by the Arkansas Highway and Transportation Department (AHTD). Once approved, any obligations for purchase under AHTD's successful bids shall commit the respective City department, entity, or representative to purchase and pay for said supplies, services, equipment, and/or materials directly to any ORDINANCE NO. 1524 (#4 Page • vendor under the terms and conditions as required in the current approved AHTD bid. Because doing so is optional, each such purchase will be assessed and a determination made whether participating and using AHTD's successful bid will allow the City and its authorized entities to save money, time, and efforts over conducting a bidding process itself for the same or similar item(s). (B) Waiver of Competitive Bidding. Because of the potential economic savings for City departments, entities, and authorized representatives to participate in purchases through use of the AHTD's bidding process, it is unfeasible and impractical to solicit bids for such supplies, services, equipment, and/or materials that satisfy City specifications when such are available through AHTD's successful bids. As such, and by authority granted in ACA § 14-58-303, the City of Jacksonville, the Jacksonville Wastewater Utility, and the Jacksonville Water Works, together with their various departments, entities, and authorized representatives, are hereby authorized to purchase any and all appropriate supplies, services, equipment, and/or materials available through the AHTD's bidding process deemed necessary and efficient for the effective operation of the City, its utilities, departments, entities, and authorized representatives. Such purchases can be made without necessity of duplication of competitive bidding when AHTD has done so, and the City, its utilities, departments, entities, and authorized representatives shall avoid any unnecessary duplication of effort when waiving competitive bidding satisfies their applicable specifications and needs. SECTION TWO: All Ordinances or parts thereof in conflict herewith are hereby repealed to the extent of said conflict. SECTION THREE: If the City Government is to operate in an economical and efficient manner, it is imperative that authority be granted to utilize said purchasing process as soon as possible.
