0723 \,53 ORDINANCE NO. 723 AN ORDINANCE AMENDING ORDINANCE NO. 268 OF 1972, ORDINANCE NO. 350 OF 1975, AND ORDINANCE NO. 541 OF 1979; FIXING RATES FOR SERVICES TO BE RENDERED BY THE SEWER SYSTEM OF THE CITY OF JACKSONVILLE, ARKANSAS; PRESCRIBING OTHER MATTERS RELATING THERETO; AND DECLARING AN EMERGENCY. WHEREAS, the City of Jacksonville, Arkansas, has deter- mined to construct betterments, extensions, and improvements to its sewer system in order to better serve the residents of the City, and to establish monthly rates to be charged for services furnished and to be furnished by the sewer system for the pur- pose of providing a portion of the costs of such construction. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jacksonville, Arkansas: SECTION 1: Section 13.16.060 of the Jacksonville Municipal Code is hereby amended to read as follows: "The fol10wing monthly rates and charges, which the City Council finds and declares to be fair, reasonable, and necessary minimum rates, are fixed as rates to be charged for sewer services to be rendered by the system, effective January 1, 1984: Monthly Sewer Rates. The monthly charge for each customer shall be determined each month by average monthly water consumption, and the amount to be paid by each customer shall be computed on the basis of the following schedule of rates: All Customers Except Air Base: $4.10 $2.05 per 1,000 gallons or part thereof. The average monthly water consumption for each customer shall be determined on May 1 of each year or on the date the customer is first served by the waterworks, and shall be the average of the actual water consumption by that customer for the immediat~ly preceding months of October through March. First 2,000 gallons or part thereof Over 2,000 gallons \~: ORDINANCE NO. 7 2 3 PAGE TWO The average monthly water consumption for residential customers who were not served by the waterworks during the preceding months of October through May shal1 be deemed to be the average consumption of all residential customers. The average monthly water consumption for non-residential customers who were not served by the waterworks during the preceding months of October through May shall be deemed to be the average consump- tion of comparable non-residential customers. Surcharges for excessive strength wastewater shall be computed on the basis of actual monthly water consumption and shall be determined using the following equation: 8.34 MG c = ac C = al F = [8.34 x MG (C - Cal)] F ac Where, = The approximate weight of one gallon of water in pounds (lbs) The volume of water used as determined by water consumption or actual flow measurement in million gallons per month Actual concentration of a particular pollutant measured in milligrams per liter (mg/l) Allowable concentration of a particular pollutant mea- sured in mil1igrams per liter (mg/I) Rate per pound as applied to a particular pollutant that is in excess of an allowable standard for that pollutant = The following schedule of surcharge rates shall apply: $0.10 $0.08 $1.00 Air Base: $0.141 per pound of BODs (Biochemical Oxygen Demand, five day) in excess of 250 milligrams per liter (mg/l) per pound of TSS (Total Suspended Solids) in excess of 250 milligrams per liter (mg/l) per pound of oil and grease in excess of 100 milli- grams per liter (mg/l) per 1,000 gallons or part thereof actual consumption (per contract) . nStandard methods for examination of water and wastewater as published by the American Public Health Association shall be the sole and final determining factor as to the conformance, or failure thereof, of wastewater discharge. All such determinations shall be based on the discharge prior to its point of delivery to the public facilities without regard to flow, velocity, or dilution existing in the public system at the point of discharge." l'~5 ORDINANCE NO. 723 PAGE THREE SECTION 2: Section 13.16.070 of the Jacksonville Municipal Code is hereby amended to read as fol1ows: "The sanitary sewer tie-on fee shall be determined according to the size of water meter, as follows: Water Meter (Inches) 3/4 Tie-On Fee 1 1-1/2 2 4 6 Greater than 6 $ 75 100 150 200 400 600 Negotiable." SECTION 3: Section 13.16.080 of the Jacksonville Municipal Code is hereby amended to read as follows: "Customers outside the corporate limits of the City shall be charged one and one-half (1-1/2) times the monthly sewer service rates set forth in Section 13.16.060 and sanitary sewer tie-on fees set forth in Section 13.16.070." SECTION 4: The invalidity of any part of this Ordinance shall not invalidate any other part hereof. SECTION 5: All ordinances and resolutions, or parts thereof, in conflict with this Ordinance are hereby repealed. SECTION 6: It is ascertained and declared that the lack of an adequate sewer system for the needs of the City of Jacksonville, Arkansas, endangers the life, health, and property of the inhabitants of the City and that, in order to protect its inhabitants, the rates and charges set forth in this Ordinance must be immediately imple- mented in order to assist in the financing of construction of betterments, extensions, and improvements to the sewer system. IT IS, THEREFORE, declared that an emergency exists, that this Ordinance is necessary for the immediate preservation of the public peace, health, and safety, and that this Ordinance shall take effect and be in force from and immediately after its passage.
