RESOLUTION NO. 461 ( #3 -93)
A RESOLUTION EXPRESSING SUPPORT OF MAYOR TOMMY SWAIM.
WHEREAS, the City of Jacksonville and Mayor Tommy Swaim were
recently found liable for racial discrimination in the case of
former Police Chief Frank Neely; and,
WHEREAS, the City Council of the City of Jacksonville
acknowledges that the legal system of our country is the best
such system in existence, even though it is not perfect; and,
WHEREAS, for reasons still unknown to us as laypersons,
certain information about former Chief Neely's activities and
employment history, which influenced the Mayor and the City
Council in their decisions regarding him, was not allowed to be
entered as evidence during the trial and therefore remained
unknown to the jury; and,
WHEREAS, we are willing to accept the verdict of the jury
and the resulting consequences and will abide by the ruling of
the court.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: The City Council of the City of Jacksonville
steadfastly and wholeheartedly supports Mayor Tommy Swaim and his
efforts to continue to manage the affairs of this City in such a
manner that demonstrates that all employees, without regard to
race, sex, creed, color, or national origin, are treated fairly
and equally.
SECTION TWO: The City Council knows of no instances
whatsoever, in which employees have been treated unfairly or
unequally because of their race, sex, creed, color, or national
origin.
SECTION THREE: The City Council has absolutely and posi-
tively not allowed nor condoned any actions by anyone connected
with the City of Jacksonville which treat any person unfairly or
unequally because of their race, sex, creed, color, or national
origin, whether or not such actions are a violation of any
federal or state laws, because such actions are morally wrong.
SECTION FOUR: The City Council hereby requests Mayor Tommy
Swaim to continue programs for City officials and employees to
ensure, as well as humanly possible, that no discriminatory
actions are made by any city officials or employees nor the
appearance of any discriminatory actions are made by an city
officials or employees.
SECTION FIVE: This Resolution shall be in effect from and
after its date of passage.
APPROVED AND ADOPTED THIS FIRST DAY OF APRIL, 1993.
