0454 RESOLUTION NO. 454 ( #12 -92)
A RESOLUTION CONDEMNING THE STRUCTURE(S) AND REAL PROPERTY
LOCATED AT 105 DENNIS LANE, JACKSONVILLE, ARKANSAS, BECAUSE OF
STRUCTURAL DEFECTS AND DEFICIENCIES; AND, FOR OTHER PURPOSES.
WHEREAS, the structure(s) and real property located at
105 Dennis Lane, in the City of Jacksonville, owned by Ms.
Dorothy Head, 105 Dennis Lane, Jacksonville, Arkansas 72076,
constitutes a health and safety hazard to the general public
because of the lack of structural soundness and dilapidated
condition of the building(s) and improvements thereon; and,
WHEREAS, despite notice and demand, said property owner
has not repaired the structure(s) and /or removed the deterio-
rated elements to eliminate the public health and safety
hazards.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY F JACKSONVILLE, :
0 ARKANSAS, THAT:
SECTION ONE: In accordance with the terms of
Jacksonville Municipal Code Section 8.26.010 et. seq., the
structure(s) and real property located at 105 Dennis Lane,
Jacksonville, Arkansas, is hereby declared to be a nuisance to
the health and safety of the citizens of Jacksonville. The
City Council hereby directs the Code Enforcement Office to
give notice to the property owner, Ms. Dorothy Head of 105
Dennis Lane, Jacksonville, Arkansas 72076, that if said
structure(s) and real property is not repaired and the health
and safety hazards removed from such within thirty (30) days
from the date of passage of this Resolution, the structure(s)
and real property at 105 Dennis Lane will be cleared and all
structure(s) removed so as to eliminate any health or safety
hazard(s) to the general public.
SECTION TWO: If the City of Jacksonville is required to
undertake and /or complete said removal of hazardous condi-
tions from the real property in question, the City will then
file a lien against said real property for collection of all
reasonable costs incurred to undertake and complete said task.
SECTION THREE: All Resolutions or parts of Resolutions
in conflict herewith are hereby repealed to the extent of said
conflict.
