0623 RESOLUTION NO. 623 ( #2 - 2009)
A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE
ALL NECESSARY DOCUMENTS IN EFFORTS TO SECURE AND COMPLETE THE
SALE OP THE REAL ESTATE FORMERLY KNOWN AS THE ESTHER D. NIXON
PUBLIC LIBRARY, AND, FOR OTHER PURPOSES.
WHEREAS, the City of Jacksonville, Arkansas, through negotiations approved two years
ago, was able to secure approval of a purchase contract for the sale of the City-owned property
and facility formerly known as the Esther D. Nixon Public Library, located at 308 West Main,
Jacksonville, Arkansas; and,
WHEREAS, the City Council believes that the purchase agreement is fair and equitable,
as the property is being sold at fair market value to the adjoining property owner who has
shared common parking facilities for over forty (40) years. As such, the Mayor and City Clerk
should be authorized to complete at the negotiated favorable terms the necessary and
appropriate documents required to transfer title to the property in question.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS, THAT.'
SECTION ONE: To assist in completion of the terms of the parties' agreement for
the purchase and sale of the property formerly known as the Esther D. Nixon Public Library,
located at 308 West Main, Jacksonville, Arkansas, which satisfied the public with library facilities
in Jacksonville for over forty (40) years, the Mayor and City Clerk are hereby authorized and
directed to complete at the negotiated terms all appropriate agreements and documents
necessary to secure the transfer of title to the facilities and adjoining real property to the
purchaser of the property, First United Methodist Church of Jacksonville, Arkansas.
SECTION TWO: Any and all other Resolutions in conflict herewith are hereby
repealed to the extent of said conflict. This Resolution shall be in effect from and after its date
of passage.
