ORDINANCE NO. 6 6 2
AN ORDINANCE PROVIDING FOR THE WAIVING OF REQUIREMENT OF
COMPETITIVE BIDDING IN EXCEPTIONAL SITUATIONS WHERE SUCH
PROCEDURE IS DEEMED NOT FEASIBLE OR PRACTICAL: FOR OTHER
PURPOSES AND DECLARING AN EMERGENCY.
WHEREAS, the City Council of the City of Jacksonville,
deems it necessary to establish an ordinance providing for
the waiving of requirements of competitive bidding in ex-
ceptional si tuations where such procedure is deemed not
feasible or practical, and
WHEREAS, Act 28 of 1959 of the General Assembly of the
State of Arkansas and Ark. Statute 19-4425 provides that the
City Council may, by ordinance, waive the requirements of
competitive bidding, and
WHEREAS, the City Council of the City of Jacksonville
deems it necessary to establish such an ordinance, and
WHEREAS, the Jacksonville Fire Department needs to
immediately replace the heater in Number 2 Fire Station in
order to keep same inhabitable, and
WHEREAS, the present heater is being serviced daily, and
WHEREAS, the City Council of the City of Jacksonville
deems it necessary to authorize the Jacksonville Fire De-
partment to waive the requirements of competitive bidding on
the replacement of the heater at Fire Station Number 2.
NOW THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS, that:
Section 1. That the Jacksonville Fire Department is
author i zed irnmed iately to purchase a new heater for Fi re
Station Number 2.
Section 2. That the Ci ty Council of the Ci ty of
Jacksonville, deems it necessary to waive the requirements of
competi tive bidding due to the fact that such is needed
immediately.
Section 3. This ordinance being necessary for the
immediate preservation of the health, safety and morale of
the c i ti zens of the City of Jac ksonvi II e, Ar kansas, an
emergency is hereby declared to exist and this ordinance
shall take effect immediately upon its passage and approval.
