RESOLUTION NO. 577 (#5 - 04)
A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK OF THE
CITY OF JACKSONVILLE, ARKANSAS, TO EXECUTE THE
APPROPRIATE DOCUMENTS FOR THE SALE OF CERTAIN REAL
PROPERTY; AND, FOR OTHER PURPOSES.
WHEREAS, the development and centralization of wastewater
services in the City over recent years at the Johnson Plant has resulted
in an elimination of use of certain real property owned by the City
through the Jacksonville Wastewater Utility;
WHEREAS, acquisitions and current uses of real property by the
Jacksonville Wastewater Utility has resulted in ownership of properties that no
longer serve a purpose for the Jacksonville Wastewater Utility; and,
WHEREAS, after placing said property up for public bid, the Jacksonville
Sewer Commission has voted to recommend selling certain real property under
certain conditions.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: The Mayor and City Clerk are hereby authorized to
execute the necessary documentation on behalf of the Jacksonville Wastewater
Utility for disposition and sale of the real property described below owned by
the City of Jacksonville by and through the Wastewater Utility to the successful
bidders. The property to be transferred is more fully described as follows:
TRACT 1:
6.07 acres known as a part of the West Sewer Treatment Plant, more
particularly described as follows:
A tract of land located in the Northwest Quarter (NW 1/4) of the
Northwest Quarter (NW 1 /4) of Section 25, Township 3 North,
Range 11 West, in the City of Jacksonville, Pulaski County,
Arkansas, being more particularly described as follows:
Commence at the SW Corner of the NW 1/4 of the NW 1/4 of said
Section 25; thence S 03° 34' W, 388.0 feet; thence S 87° 56' E,
1,877.76 feet to the southeast comer of Lot 8 of Campbell's
Industrial Subdivision; thence S 15° 42' 56" W, 219.49 feet to an
iron pin and the point of beginning; thence S 29° 02' 11" E,
303.09 feet; thence S 61° 48' 58" W, 865.28 feet; thence N 32° 16'
38" W, 302.40 feet; thence N 61° 43' 24" E, 882.36 feet to the
point of beginning, containing 6.07 acres, more or less.
TRACT 2:
5.98 acres known as a part of the West Sewer Treatment Plant, more
particularly described as follows:
A tract of land located in the Northwest Quarter (NW 1 /4) of the
Northwest Quarter (NW 1/4) of Section 25, Township 3 North,
Range 11 West, in the City of Jacksonville, Pulaski County,

Arkansas, being more particularly described as follows:
Commence at the SW corner of said NW 1/4 of Section 21, T -3 -N,
R -10 -W; thence S 89° 05' 00" E, 1124.58 feet along the south line of
said NW 1/4; thence N 00° 39' 39" E, 18.84 feet; thence S 87° 51'
00" E, 130.92 feet to the point of beginning; thence S 89° 05' 00" E,
1320 feet; thence N 01° 23' 23» E, 990 feet; thence N 89° 05' 00" W,
1320 feet; thence S 01° 23' 23" W, 990 feet to the point of
beginning; containing 30 acres, more or less.
SECTION TWO: The documentation executed to transfer said
properties will provide appropriate limitations regarding potential future uses
and provisions for relevant issues regarding the property being transferred in
order to satisfy federal directives and guidelines.
SECTION THREE: Any and all other Resolutions in conflict herewith are
hereby repealed to the extent of said conflict. This Resolution shall be in effect
from and after its date of passage.
