0798 ,~~ ORVINANCE NO. 7 9 8 (#31-85) AN ORDINANCE AUTHORIZING LAW ENFORCEMENT AGENCIES TO ISSUE CITATIONS FOR ANY VEHICLE NOT DISPLAYING THE AUTHORIZED HANDICAPPED DECAL PARKED IN ANY PUBLIC OR PRIVATE PARKING AREA DESIGNATED FOR THE EXCLUSIVE USE OF DISABLED PERSONS; DECLARING AN EMERGENCY AND FOR OTHER PURPOSES. WHEREAS, Ark. Stat. Ann. S19-2350 has been amended by the General Assembly of the State of Arkansas to provide that munici- palities of the State may enact ordinances to limit and control the use of parking spaces in public and private parking areas designated for the exclusive use of disabled persons; and WHEREAS, the Jacksonville Junior Auxiliary and other CiV1C organizations have expressed concern over the abusive use of the parking areas designated for disabled persons by the general public; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT: SECTION 1: That all law enforcement agencies authorized to issue citations within the city limits of the City of Jacksonville, Arkansas are authorized and directed to issue cita- tions to any vehicle not displaying the authorized handicapped decal parked in any public or private parking area designated for the exclusive use of disabled persons. SECTION 2: Due to the fact that the safety and welfare of the citizens of Jacksonville is involved, it is declared that a potential hazard to the health, safety and welfare of the citi- zens of the City of Jacksonville exists. It is, therefore, declared that an emergency exists and this Ordinance, being necessary for the immediate needs of the public health and safety, shall take effect and be in force from and after its passage. SECTION 3: All ordinances or resolutions in conflict herewith are hereby repealed to the extent of said conflict. APPROVED AND ADOPTED THIS 7TH DAY OF NOVEMBER 1985.
