RESOLUTION NO. 560 ( #5 - 02)
A RESOLUTION REQUESTING ACQUISITION OF THE UIVION PACIFIC
RAILROAD LINE RIGHTS- OF- WAY/EASEMENT CURRENTLY OWNED
BUT NOT UTILIZED BY THE LITTLE ROCK AIR FORCE BASE
(GENERAL LOCATION: SPUR LINE TO THE LITTLE ROCK AIR FORCE
BASE THROUGH THE JACKSONVILLE INDUSTRIAL PARK); AND, FOR
OTHER PURPOSES.
WHEREAS, the City of Jacksonville has learned that the United States
Air Force is considering abandonment of the unused easement /rights -of -way to
the Union Pacific Railroad Line spur that runs through the Jacksonville
Industrial Park to the Little Rock Air Force Base;
WHEREAS, the City could utilize said spur line (i.e., easement /rights -of-
way) for the benefit of the community through greater support of existing local
industry shipping needs, promotion of new industry in the park through
improvement to shipping capabilities, enhance control of safety concerns for the
citizens of Jacksonville, and address current maintenance needs for the spur.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: The City of Jacksonville hereby request that the
United States Air Force, by and through the Little Rock Air Force, release and
transfer any and all rights and privileges to the unused railroad
easement /rights -of -way currently held by the United States Air Force of the
Union Pacific Railroad Line's spur that runs through the Jacksonville Industrial
Park area to the Little Rock Air Force Base. The City hereby dedicates that
future usage of said easement /rights -of -way areas would forever be used for
public access, benefits, and purposes.
SECTION TWO: The Mayor is hereby authorized to represent the City
in negotiations with Little Rock Air Force /United States Air Force
representatives for the acquisition of the Union Pacific Railroad Line railroad
easement /rights -of -way located between the railroad's main line and the Little
Rock Air Force Base, Jacksonville, Arkansas. Should said negotiations be
successful, the Mayor and City Clerk are further authorized to execute any and
all documents necessary to complete the transfer of said easement /rights -of-
way.
SECTION THREE: Any and all other Resolutions in conflict herewith are
hereby repealed to the extent of said conflict. This Resolution shall be in effect
from and after its date of passage. ``tt
