0559 RESOLUTION NO. 559 ( #4 - 02) A RESOLUTION URGING SUPPORT OF THE PROPOSED ANNEXATION OF CERTAIN REAL PROPERTY BORDERING THE SOUTHEAST BOUNDARIES OF THE CITY LIMITS OF JACKSONVILLE (COMMONLY KNOWN AS THE SOUTHEAST ANNEXATION); AND, FOR OTHER PURPOSES. WHEREAS, certain residents of real property on the Southeast side of Jacksonville desire that their real properties be annexed into the city limits of the City of Jacksonville, Arkansas; WHEREAS, the City of Jacksonville, Arkansas, is the adjoining and surrounding duly organized municipality within Pulaski County to said properties; and, WHEREAS, the City of Jacksonville, Arkansas, and a majority of certain real estate owners of the Southeast side of Jacksonville are in agreement that annexation of certain property located on the Southeast side of Jacksonville, as more particularly described below, would be advantageous and beneficial to all parties concerned. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT: SECTION ONE: The City Council wholeheartedly urges support and approval of the proposed annexation of the real property located on the Southeast side of Jacksonville, as shown on the attached map (identified as Attachment "A" and made a part hereof). SECTION TWO: The following real property, as more particularly described below and as shown on the attached map, shall be annexed and accepted by the City of Jacksonville, Arkansas: SOUTHEAST PROPERTY TRACT A Part of the West 1/2 of Section 28, Township 3 North, Range 10 West, Pulaski County, Arkansas, being more particularly described as follows: Beginning at a point on the East line of the SW 1/4 of Section 28, Township 3 North, Range 10 West, said point being 48.84' S 02° 20' 55" W from the NE corner of Section 28, Township 3 North, Range 10 West; thence 5 02° 20' 55" W, 1283.00' to the SE corner of the NE 1/4 of the SW 1/4 of Section 28, Township 3 North, Range 10 West, thence N 89° 27' 04" W along the South line of said NE 1/4 of the SW 1/4, 557.68'; thence S 01° 22' 40" W, 643.17'; thence S 89° 54' 59" W, 673.59' to the West line of the SE 1/4 of the SW 1/4; thence Southerly along said West line of the SE 1/4 of the SW 1/4, 626.25' to the North right -of -way line of Military Road; thence Westerly along said North right -of -way line to the West right -of -way line of Loop Road; thence N 16° 28' 40" E along said right -of -way line 622. 04'; thence along a curve to the left (A =15 °, R= 1859.8', T= 244.84') a distance of 487.01'; thence Northerly along West right -of -way line of Loop Road to existing City limits, 330' South of Graham Road; thence East 100' along said City limits to the East right -of -way line of Loop Road; thence Southerly along the East right -of -way line of Loop Road to the North line of the NW 1/4 of the SW 1/4; thence S 01 ° 05' 29" E, 48.77'; thence S 89 ° 27' 19" E, 1496.43', to the point of beginning; containing approximately 72.81 acres more or less. 0000:i RESOLUTION NO. 559 ( #4 —02) March P*, 2002 Page Two TRACT B Part of the NW 1/4 of the NW 1/4 of Section 28, Township 3 North, Range 10 West, and part of the SW 1/4 of Section 21, Township 3 North, Range 10 West, Pulaski County, Arkansas being more particularly described as follows: Commencing at the NE corner of the NW 1/4 of the SW 1/4 Section 21, Township 3 North, Range 10 West; thence 89° 05 W, 199.52' to the East right -of -way line of Loop Road and the point of beginning; thence South along East right -of -way line of Loop Road to the South line of Section 21, Township 3 North, Range 10 West; thence South along the East right - of -way line of Loop Road 30' to the south right -of -way line of Graham Road and the existing City limits; thence West along the South right -of -way line of Graham Road to the West line of the NW 1/4 of Section 28, Township 3 North, Range 10 West; thence North 30' along said West line to the NW corner of the NW 1/4 of said Section 28, Township 3 North, Range 10 West; thence N 89° 27' 40" E, 435.02'; thence N 01 19' 40" W, 1329.38' to the Northeast corner of Heritage Park Subdivision; thence N 88° 03' E, 606.64' to the West right -of -way line of Loop Road; thence North along West right - of -way line of Loop Road to the North line of the South half of Section 21, Township 3 North, Range 10 West; thence East along said North line of the P 9 9 South half of Section 21, Township 3 North, Range 10 West, 100' to the point of beginning; containing 25.85 acres more or less. SECTION THREE: The Mayor, City Clerk, and City Attorney are hereby authorized to prepare, execute, and file the appropriate documents required to complete said annexation process. SECTION FOUR: Upon approval of said annexation by the Pulaski County Judge, F. G. (Buddy) Villines, the City Council hereby agrees to authorize, accept, and approve the annexation of the above described property by the City of Jacksonville. SECTION FIVE: Any and all resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of said conflict.
