ORDINANCE NO. 786 (#19-85)
AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR WORKMEN'S
COMPENSATION INSURANCE FOR THE CITY OF JACKSONVILLE: DECLARING AN
EMERGENCY; AND FOR OTHER PURPOSES.
WHEREAS, it is necessary under Arkansas law to provide
workmen's compensation insurance for the employees of the City of
Jacksonville, and
WHEREAS, State law sets the premiums and there is no
variance of price between insurance companies, and
WHEREAS, the Insurance Mart has provided excellent service
to the City on other contracts of insurance, and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS, THAT:
1. Competitive bidding for workmen's compensation
insurance for the City of Jacksonville would be costly and
nonproductive, making said competitive bidding not feasible or
practical as there is no variance in rates as same are set by
State law.
2. We hereby waive competitive bidding pursuant to Ark.
Stat. Ann. S19-4425, for the purchase of workmen's compensation
insurance and authorize the purchase for said insurance through
Tim Sparks of The Insurance Mart.
3. Whereas, there exists an emergency situation as a
result of a need for City employees to be covered by workmen's
compensation insurance, it is necessary for the protection of the
citizens' public health, safety and welfare, for this ordinance
to be in effect immediately. We hereby declare an emergency to
exist.
