0781 PCJ2; ORDINANCE NO. 781 AN ORDINANCE AMENDING ORDINANCE NO. 542 and 647, SPECIFICALLY CODIFIED SECTIONS 3.08.020, 3.08.030 and 3.08.035 OF THE JACKSONVILLE MUNICIPAL CODE, RAISING THE PURCHASING LIMITATION ON EXPENDITURES WITHOUT COMPETITIVE BIDDING, DECLARING AN EMERGENCY AND FOR OTHER PURPOSES. WHEREAS, The present Ordinances concerning the purchasing limitation on expenditures without competitive bidding are currently limited to these expenditures at state bid prices of less than Two Thousand Dollars, and WHEREAS, The Arkansas State Legislature enacted a new state statute allowing Arkansas cities to increase the limita- tion to expenditures, at state bid prices, of less than Five Thousand Dollars, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT: SECTION 1: Part of Ordinance No. 542 and 647 of the City of Jacksonville, specifically that part codified as Sections 3.08.020, 3.08.030, and 3.08.035 of the Jacksonville Municipal Code, should be and hereby are amended to read as follows: "3.08.020. Expenditure above Five Hundred Dollars but below Five Thousand Dollars - Bids. All purchases for the City of supplies, apparatus, equip- ment purposes where the expenditure therefore is in excess of Five Hundred Dollars but less than Five Thousand Dollars shall be made by the mayor, or his duly authorized representative, after the securing of quotation bids therefor; provided, however, purchases of less than Five Thousand Dollars, at state bids prices, shall be exempt from the provisions of this chapter." "3.08.030. Expenditure exceeding Five Thousand Dollars Competitive bids by legal advertis~ment. Where the amount of expenditure for any purchase or contract exceeds the sum of Five Thousand Dollars, the mayor, or his duly authorized representative, shall invite competitive bids thereon by legal advertisement in any local newspaper. Bids received pursuant to the adver- tisement shall be opened and read on the date set for receiving the bids, in the presence of the mayor, or his duly authorized representative. The contract shall be awarded to the lowest responsible bidder; provided, however, that the mayor or his duly authorized represen- tative may reject any and all bids received." 113.08.035. Purchase over Five Thousand Dollars. On all purchases of supplies, equipment or service of more than Five Thousand Dollars, advertisement for bids must be taken pursuant to Ark. Stat. Ann. S19-4425 unless the City Council shall by ordinance waive competitive bidding in exceptional situations where such procedure is deemed unfeasible or practical." ~Oq SECTION 2: Whereas, the purpose of this amendment is to eliminate the confusion surrounding the existing ordinances, it is deemed an emergency and shall take effect immediately upon passage in order to protect the public health, safety and welfare. SECTION 3: That all ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. APPROVED AND ADOPTED THIS DAY OF APRIL, 1985.
