0414 RESOLUTION NO. 4 1 4 ( #8-89) A RESOLUTION REFERRING TO THE PEOPLE OF THE CITY OF JACK- SONVILLE, ARKANSAS, FOR ADOPTION OR REJECTION, AN ORDINANCE LEVYING A ONE- PERCENT GROSS RECEIPTS TAX ON THE GROSS RECEIPTS OF HOTELS, MOTELS AND RESTAURANTS WHEREAS, there has been introduced in the City Council of the City of Jacksonville, Arkansas (the "City "), a proposed Ordinance entitled: "An Ordinance Levying a Tax of One Percent (1 %) upon the Gross Receipts of Hotels, Motels and Restaurants, Prescribing the Uses Therefor, Creating the City of Jacksonville Advertising and Promotion Commission, and For Other Purposes" (the "Proposed Ordinance "); and WHEREAS, the City Council has determined to refer the Proposed Ordinance to the people of the City for adoption or rejection; and WHEREAS, there is an urgent necessity that the Proposed Ordinance be adopted or rejected as soon as feasible, taking into consideration the time required to give the people adequate notice of a special election on the question and the opportunity to vote thereon; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Jacksonville, Arkansas: SECTION 1: In accordance with the provisions of Ark. Code Ann. g14 -55 -301 (1987), the Proposed Ordinance is hereby referred to the qualified electors of the City for adoption or rejection, at a special election in the City to be held on the 7th day of November 1989. SECTION 2: At the special election, the question shall be presented in substantially the following form: "Vote FOR or AGAINST the adoption of a Proposed Ordinance of the City of Jacksonville, Arkansas, entitled: 'An Ordinance Levying a Tax of One Percent (1 %) upon the Gross Receipts of Hotels, Motels and Restaurants, Prescribing the Uses Therefor, Creating the City of Jacksonville Advertising and Promotion Commission, and For Other Purposes' FOR the adoption of the Proposed Ordinance / / AGAINST the adoption of the Proposed Ordinance / /" SECTION 3. A copy of this Resolution shall be delivered to the Pulaski County Board of Election Commissioners with the request that the Commissioners provide the necessary election officials and supplies and conduct the special election hereby called in accordance with applicable law. SECTION 4. The Mayor is authorized and directed, in co- operation with the Board of Election Commissioners, to cause notice or proclamation of the election to be given by such (P3 methods as deemed adequate to enable the people of the City to be advised of the referral of the Proposed Ordinance at the special election and their right to vote in the special election.
