ORDINANCE NO. 7 5 6 AN ORDINANCE SUBMITTING AT THE GENERAL ELECTION IN THE CITY OF JACKSONVILLE, ARKANSAS, ON NOVEMBER 6, 1984, THE QUESTION OF LEVYING A ONE PERCENT GROSS RECEIPTS TAX UPON HOTELS, MOTELS AND RESTAURANTS, AND FOR OTHER PURPOSES. WHEREAS, the City of Jacksonville, Arkansas, is a City of the first class; and WHEREAS, pursuant to Ark. Stat. Ann. ~~19-4613 through 19-4617, a City of the First Class is authorized to levy a one percent (1%) gross receipts tax upon renting, leasing or otherwise furnishing of hotel or motel accommodations, and upon the proceeds of restaurants, cafes and cafeterias within the corporate limits of such Cities; and to create a fund to be known as the City Ad- vertising and Tourist Promotion Fund to be used exclusively for advertising and promoting such City and its environs and/or for the extension, equipment, improvement, maintenance, repair and operation of a convention center or convention centers in such City, and facilities necessary for, supporting or otherwise per- taining to, a convention center in the manner as determined by a City Advertising and Tourist Promotion Commission, and the crea- tion and implementation of said Commission; and that WHEREAS, the City Council of the City of Jacksonville desire voter input before imposing this tax; NOW, THEREFORE BE IT ORDAINED by the City Council of Jacksonville, Arkansas: Section 1. That there be submitted to the electors of the City of Jacksonville at the general election to be held on Novem- ber 6, 1984, the question of whether a one percent (1%) gross receipts tax upon renting, leasing or otherwise furnishing of hotel or motel accommodations, and upon the proceeds of restaurants, cafes and cafeterias within the corporate limits of the City of Jacksonville and to create the Funds and Commissions necessary to accomplish the purposes of promoting Jacksonville's tourism and advertising. Section 2. The question shall be placed on the ballot for the election in substantially the following form: Vote on rneasure by placing an "X" in the square above the measure either for or against: For authorizing the City Council to levy a one percent gross receipts tax on renting, leasing or otherwise furnishing of hotel or motel accommodations, and upon the proceeds of restaurants, cafes and cafeterias within the corporate limits of Jacksonville, Arkansas to be used for the purpose of advertising and pro- moting the City of Jacksonville..................../ / Against authorizing the City Council to levy a one percent gross receipts tax on renting, leasing or otherwise furnishing of hotel or motel accommodations, and upon the proceeds of restaurants, cafes and cafe- terias within the corporate limits of Jacksonville, Arkansas to be used for the purpose of advertising and promoting the City of Jacksonville............./ / CoB Section 3. That the election shall be held and conducted and the vote canvassed and the results declared under the law and in the manner now provided for municipal elections, so far as the same is applicable, and the Mayor of the City is hereby authorized and directed to give notice of such election by an advertisement published weekly once a week for four times in a newspaper published in the City, and having a bona fide circulation therein, the last publication to be not less than ten days prior to the date of the election, and only qualified voters of the City shall have the right to vote at said election on said question. Section 4. That the results of the election shall be pro- claimed by the Mayor and his Proclamation shall be published one time in a newspaper published in the City and having a bona fide circulation therein, which Proclamation shall advise that the results as proclaimed shall be conclusive unless attacked in the courts within thirty (30) days after the date of such Proclamation. Section 5. That a copy of this Ordinance shall be given to the Pulaski County Board of Election Commissioners so that the necessary election officials and supplies may be provided. Section 6. That all ordinances and parts thereof in con- flict herewith are hereby repealed to the extent of such conflict. Section 7. That it is hereby ascertained and declared that there is an imme.diate need for the levying of the above described gross receipts tax order that the public health, welfare and safety may be protected. It is therefore, declared that an emergency exists, and this Ordinance being necessary for the immediate pre- servation of the public peace, health and safety shall be in force and take effect immediately from and after its passage.
