AN ORDINANCE WAIVING THE REQUIREMENTS OF COMPETITIVE BIDDING
IN REGARD TO CONTRACTING FOR THE PURCHASE OF A CIVIL DEFENSE
SIREN; AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE,
ARKANSAS, THAT:
Section 1: Pursuant to Arkansas Statutes Annotated Sec-
tion 19-4425, we hereby waive the requirements of competitive
bidding in regard to the purchase of a civil defense siren for
the City of Jacksonville.
Section 2: We hereby state that the requirements of com-
petitive bidding in this instance would not be feasible or
practical in that bids have already been taken and Ferrier's
has not fulfilled the contract and cannot now complete the
contract as they are unable to deliver the siren. The manu-
facturer of the siren is Federal Signal Corporation and the
only other distributor in the area who can beat the previous
bid price is Treadway Electric Company of Little Rock. As
the need for this equipment is immediate and as bids were put
out in November of 1983, and the purchase price is less than
the low bid, it is necessary to waive competitive bidding.
Section 3: We hereby authorize the City of Jacksonville
to contract with Treadway Electric Company of Little Rock for
the purchase of a civil defense siren in the sum of approxi-
mately $9,000.00 plus tax, and authorize the cancelling of
the contract with Ferrier's as they failed to deliver within
60 days as contracted for.
Section 4: That all ordinances or parts of ordinances
in conflict herewith are hereby repealed to the extent of any
such conflict.
