0740 PAGE 37 ORDINANCE NO. 740 AN ORDINANCE WAIVING THE REQUIREMENTS OF COMPETITIVE BIDDING IN REGARD TO CONTRACTING FOR THE PURCHASE OF AN INTOXILYZER 4011-AS FOR THE POLICE DEPARTMENT, CITY OF JACKSONVILLE; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT: Section 1: Pursuant to Arkansas Statutes Annotated Section 19-4425, we hereby waive the requirements of competitive bidding in regard to the purchase of an Intoxilyzer 4011-AS for the Police Department. Section 2: We hereby state that the requirements of compe- titive bidding in this instance would not be feasible or practical in that the company who has submitted a bid is the sole distributor of this type machine in the area. The officers were trained on this machine, at great expense to the city, and a different machine would require new training at great expense to the city. Under these circumstances competitive bidding would be fruitless and nonproductive and costly to the City. Section 3: We hereby authorize the City of Jacksonville's Police Department to contract with CMI, Inc., a subsidiary of Federal Signal Corporation at the cost of $3,800.00. Section 4: That all ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of any such conflict.
