0739 ~GE3~ ORDINANCE NO. 739 AN ORDINANCE AMENDING ORDINANCE NO. 268 OF 1972, ORDINANCE NO. 350 OF 1975, AND ORDINANCE NO. 541 OF 1979, AS AMENDED BY ORDINANCE NO. 723 'AND ORDINANCE NO. 731 OF 1983 FOR SER- VICES TO BE RENDERED BY THE SEWER SYSTEM OF THE CITY OF JACKSONVILLE, ARKANSAS: PRESCRIBING OTHER MATTERS RELATING THERETO; AND DECLARING AN EMERGENCY. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jacksonville, Arkansas: SECTION 1: Section 1 of Ordinance No. 731 is hereby amended to read as follows: "The following monthly rates and charges, which the City Council finds and declares to be fair, reasonable, and necessary minimum rates, are fixed as rates to be charged for sewer ser- vices to be rendered by the system, effective March 1, 1984." Monthly Sewer Rates: The monthly charge for each customer shal1 be determined each month on the basis of the following schedule of rates: All Customers Except Air Base: First 2,000 gallons or part thereof Over 2,000 gal10ns $4.10 $1.43 per 1,000 gal10ns or part thereof Residential: Charges shall be assessed on all metered consumption, however, during the months of May through September sewer charges shall not exceed the amount that would be assessed based on each individuals average consumption for the preceding months of October through March. Commercial and Industrial: Charges shall be assessed on all metered consumption or by an approved method of actual flow measurement. Surcharges for excessive strength wastewater shal1 be computed on the basis of actual monthly water consumption or an approved method of actual flow measurement and shall be determined using the following equation: PAGE 35 ORDINANCE NO. 7 3 9 PAGE rwo (8.34 x MG (Cae - Ca1) F Where: 8.34 = The approximate weight of one gallon of water in pounds (lbs) MG = The volume of water used as determined by water consumption or actual flow measurement in mil1ion gallons per month C ac = Actual concentration of a particular pollutant measured in mil1igrams per liter (mg/l) Cal = Allowable concentration of a particular pollutant measured in milligrams per liter (mg/l) F = Rate per pound as applied to a particular pollutant that is in excess of an allowable standard- for that pollutant The following schedule of surcharge rates shall apply: $0.10 per pound of BODS (Biochemical Oxygen Demand), five day) in excess of 250 milligrams per liter (mg/l) $0.08 per pound of TSS (Total Suspended Solids) in excess of 250 milligrams per liter (mg/l) $1.00 per pound of oil and grease in excess of 100 milligrams per liter (mg/l) Air Base: $0.141 per 1,000 gallons or part thereof actual consumption (per contract) . "Standard methods for examination of water and wastewater as published by the American public Health Association shall be the sole and final determining factor as to the conformance, or failure thereof, or wastewater discharge. All such determinations shall be based on the discharge prior to its point of delivery to the public facilities without regard to flow, velocity, or dilu- tion existing in the public system at the point of discharge." SECTION 2: The invalidity of any part of this Ordinance shall not invalidate any other part hereof. PAGE ~ ORDINANCE NO. 7 3 9 PAGE };/1REE SECTION 3: AIl ordinances and resolutions, or parts thereof, in conflict with this Ordinance are hereby repealed. SECTION 4: It is ascertained and declared that the lack of an adequate sewer system for the needs of the City of Jack- sonville, Arkansas, endangers the life, health, and property of the inhabitants of the City and that, in order to protect its inhabitants, the rates and charges set forth in this Ordinance must be immediately implemented in order to assist in the financing of construction of betterments, extensions, and improvements to the sewer system. IT IS, THEREFORE, declared that an emergency exists, that this Ordinance is necessary for the immediate preservation of the public peace, health, and safety, and that this Ordinance shal1 take effect and be in force from and immediately after its passage.
