0736 PAGE 30 ORDINANCE NO. 7 3 6 AN ORDINANCE PROHIBITING THE OPERATION OF THREE WHEELERS WITHIN THE CITY LIMITS OF JACKSONVILLE, ARKANSAS; DECLARING AN EMERGENCY AND FOR OTHER PURPOSES. WHEREAS, there has been an increasing number of accidents involving three wheelers and an alarming number of cases of vandalism involving three wheelers; there exis,ts in the City of Jacksonville a need to prohibit the use of said three wheelers within the city limits of Jacksonville in order to preserve the health, safety and welfare of the inhabitants,: THEREFORE, Be it ordained by the Ci ty Council of th,e Ci ty of Jacksonville, Arkansas, THAT: S'ection 1: It is unlawful to operate a three wheeler within the city limits of Jacksonville, Arkansas. "Three wheeler" shall mean every motor vehicle or cycle having a seat or saddle for use of the rider and designed to travel on three (3) wheels in contact with the ground, but excluding a tractor and a motorized bicycle. Section 2: This Ordinance shall not prohibit operation of three wheelers on one's own private property. Section 3: Every person who is convicted of a violation of this Ordinance shal1 be punished by a fine of not less than one-hundred dollars ($100.00), nor more than three-hundred dollars ($300.00). On a second or subsequent conviction of a violation of this Ordinance, a person shall be punished by a fine of not less than two-hundred dollars ($200.00), nor more than five-hundred dollars ($500.00) and at the discretion of the judge may be imprisoned for not more than ten (10) days. Section 4: The invalidity of any part of this Ordinance shall not invalidate any other part hereof. Section 5: All Ordinances and Resolutions, or parts thereof, in conflict with this Ordinance are hereby repealed. Section 6: It is ascertained and declared that the need to prohibit the use of three wheelers within the city limits of Jacksonvil1e is necessary for the preservation of the life, ORDINANCE NO. PAGE .3/ health, and p,roperty of the inhabitants of the City and that in order to protect its inhabitants, the penalty set forth in this Ordinance must be immediately implemented in order to properly provide the needed protection. IT IS THEREFORE, declared that an emergency exists, that this Ordinance is necessary for the immediate preservation of the public peace, health, and safety, and that this Ordinance shall take effect and be in force from and ,illuuediately after its passage.
