AN ORDINANCE TO LEVY AN ADDITIONAL COURT COST ON THOSE
INDIVIDUALS WHO PLEAD GUILTY, NOLO CONTENDERE OR IS
FOUND GUILTY OF ANY CRIMINAL CHARGE IN THE CITY OF
JACKSONVILLE; DECLARING AN EMERGENCY AND FOR OTHER
PURPOSES.
WHEREAS, the Arkansas Statutes Annotated Section 19-2.412
allows Municipal Courts to collect certain fines, penalties and
court costs and there is a need to cover the costs of the
Jacksonville Municipal Court personnel's time and expense in-
volved in processing criminal cases:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF JACKSONVILLE,
ARKANSAS, THAT:
Section 1: The City of Jacksonville does hereby levy upon
any person who pleads guilty or nolo contendere or is found guil-
ty of any criminal charge filed in the Jacksonville Municipal
Court, an additional court cost of twentydollars and seventy-
five cents ($20.75).
Section 2: The City of Jacksonville does hereby levy upon
any person who has criminal charges filed against him or her in
the Jacksonville Municipal Court dismissed or when the deputy
prosecuting attorney elects to nolle proseque a case upon the
request of the complaining party, an additional court cost of
twenty dollars and seventy-five cents ($20.75). These costs may
be assessed or paid by either the defendant or the complaining
party and may be waived by the deputy prosecuting attorney.
Section 3: The invalidity of any part of this Ordinance
shall not invalidate any other part hereof.
Section 4: All Ordinances and Resolutions, or parts
thereof, in conflict with this Ordinance are hereby repealed
Section 5: It is ascertained and declared that the need
to strengthen the punishment for recovering some of the costs
incurred in maintaining a Municipal Court is necessary for the
preservation of the life, health, and property of the inhabi-
tants of the City and that in order to protect its inhabitants,

the court costs set forth in this Ordinance must be immediately
implemented in order to properly provide the needed protection.
IT IS THEREFORE, declared that an emergency exists, that this
Ordinance is necessary for the immediate preservation of the public
peace, health, and safety, and that this Ordinance shall take
effect and be in force from and i,rnmediately after its passage.
