SPECIAL PLANNING COMMISSION MEETING
JULY 1, 2013

OPENING REMARKS:
The Planning Commission of the City of Jacksonville, Arkansas met in
regular session on July 1, 2013. Chairman Keaton opened the meeting
at approximately 7:00 p.m. expressing appreciation to those in
attendance.
ROLL CALL: Commissioners Jim Peacock, Scott Scholl, Jim Moore, Joe
Ott, and Alderman Bill Howard answered ROLL CALL. Chairman Keaton
also answered roll call and declared a quorum. Commissioner McCleary
arrived at approximately PRESENT (7), ABSENT (2).
Others present for the meeting were City Attorney Bamburg, City
Engineer Jay Whisker, Mike Wilson, Tommy Bond, Former Alderman Bob
Stroud, interested citizens, petitioners, and press.
CORRECTION AND/OR APPROVAL OF MINUTES:
Commissioner Moore moved, seconded by Commissioner Scholl to approve
the minutes of the regularly scheduled Planning Commission meeting of
13 May 2013 as presented. MOTION CARRIED.
PUBLIC HEARING(S): a. REZONING 600 North James Street
Chairman Keaton opened the public hearing at approximately 7:03 p.m.
Petitioners for the rezoning of 600 North James Street were not
present at the meeting.
City Engineer Whisker explained to the Planning Commission that the
petitioner RLA Investments had related to him that they wanted to
rezone the residential property to operate an office from the home
located at 600 North James regarding management of rental property.
Chairman Keaton asked if anyone wanted to speak to the rezoning.
Ms. Linda Chinn, a neighbor on North James Street, explained that she
was not sure what the request was for and questioned if the property
is rezoned what would be the consequence for any other business to be
able to operate at that location. She questioned what type of
businesses would be allowed to operate in a C-1 zoning if the zoning
is approved. She noted that the neighborhood is all residential.
Ms. Chinn and another neighbor were in opposition to the rezoning to
commercial.
City Engineer Whisker answered that if the property is rezoned it
would open the property up for any business that is allowable under
the C-1 zoning, which is described as a quiet business operation.
Commissioner Ott pointed out an example of a quiet business would be
an attorney office, explaining that it is a business that would not
have a heavy in and out flow of traffic.

City Engineer Whisker read the list of businesses that are permissible
in a C-1 commercial zoning.
City Attorney Bamburg advised the Planning Commission that there are
provisions in the Jacksonville Municipal Code regarding the absence of
a petitioner to represent a requested item of business.
Alderman Howard moved, seconded by Commissioner Moore to deny the
request to rezone 600 North James Street from R-1 to C-1. MOTION
CARRIED.
Chairman Keaton closed the public hearing at approximately 7:08 p.m.
b. REZONING Tract of land on Marshall Road and General Samuels
City Engineer Whisker related that the City is proposing to rezone two
parcels of land located on Swift, Commerce, and General Samuels from
M-2 to C-1. He explained that the rezoning request is to accommodate
the possible construction of a State Veterans’ Home. He then added
that the property would be donated by the City to facilitate the site
being chosen for development. He demonstrated the location of the
parcels, pointing out that there is a 40 acre parcel to the east of
the railroad tracks
Mr. Mike Wilson related that the property is part of the PIP
Industrial area being promoted for development by the Chamber of
Commerce Foundation. He stated that it would bring need jobs to local
residents.
Discussion ensued regarding the surrounding area being zoned for
manufacturing, it was explained that the rezoning of the extra acreage
would provide a buffer.
Mr. Wilson related the need to have the rezoning approved for
application to the State by July 3, 2013.
Discussion ensued related the rezoning being conditional on the
approval from the State to build the Veterans’ Home on this site.
Commissioner Peacock moved, seconded by Commissioner Ott to approve
the rezoning of the two parcels on Swift, Commerce, and General
Samuels from M-2 to C-1 for the development of a State Veterans’ Home.
MOTION CARRIED.
REQUEST TO APPROVE PLAT(S): a. SKETCH PLAT: Harrell Subdivision
Tommy Bond of Bond Engineering stated that the lots would be five acre
plus tracts. He related that the property was formerly known as the
“old Sucka property”. He explained that the developer, Mr. Roger
Harrell is proposing to develop the property in two phases. He noted

that Emma Street would be the first phase. He then stated that the
property would be served by individual septic tanks. He stated that
the tracts are large enough to be serviced by septic tanks. It was
noted that if the lots are within 300 feet of an established sewer
main they would be required to hook onto the City sewer, however the
sketch plat is not required to have detailed utility plans.
City Engineer Whisker pointed out that the City is requesting an
easement for a sewer line in order to remove the pump station on
General Samuels that would tie into the west sewer out fall. He then
noted that the line would run along the east side of Emma Drive.
In response to a question from Commissioner Moore, Mr. Bond estimated
that the size of the homes would probably be around 2,500 square feet.
He noted that to be the minimum requirement for Foxwood Estates. The
minimum requirements for Bushwood Estates was not known.
City Engineer Whisker related that he would require a flood study be
performed regarding lots 3 going to the north, adding that lots 1 & 2
have already been completed. City Engineer Whisker then noted that the
creek flows from Paradise Lake crosses this property.
Discussion ensued regarding the Bill of Assurance being submitted with
the Preliminary Plat and concerns that it match the Bill of Assurance
for Bushwood Estates.
Alderman Howard moved, seconded by Commissioner Moore to approve the
Sketch Plat of Harrell Subdivision as submitted. MOTION CARRIED.
