REGULAR PLANNING COMMISSION MEETING

OPENING REMARKS:
The Planning Commission of the City of Jacksonville,
Arkansas met in regular session on June 11, 2012. Vice Chairman Keaton opened the meeting at approximately 7:00 p.m. expressing appreciation to those in attendance.
ROLL CALL: Commissioners
Jon Johnson, Scott Scholls, Jim Moore, Joe Ott, and Alderman Bill Howard answered ROLL CALL. Vice Chairman Keaton declared a quorum. PRESENT (6), ABSENT (3).
Others present for the
meeting were City Attorney Bamburg, City Engineer Jay Whisker, interested citizens, petitioners, and press.
NOMINATIONS for remainder of 2012 Planning Commission Chairman
Alderman
Howard moved, seconded by Commissioner Ott to nominate Vice Chairman Glen Keaton to serve as Chairman for the remainder of 2012. MOTION CARRIED.
Alderman Ott moved, seconded by Commissioner
Johnson to nominate Commissioner Joe Ott to serve as Vice Chairman of the Planning Commission and Chairman of the Board of Adjustment. MOTION CARRIED.
Commissioner Jim Moore volunteered
to serve as a Planning Commissioner serving the Board of Adjustment.
CORRECTION AND/OR APPROVAL OF MINUTES:
Commissioner Ott moved, seconded by Commissioner Scholls to approve the
minutes of the regularly scheduled Planning Commission meeting of 14 May 2012 as presented. MOTION CARRIED.
PUBLIC HEARING(S): REZONING 116 Dennis Lane from R-1 to R-5
Chairman
Keaton opened the public hearing at approximately 7:03 p.m.
Mr. Wystan Epting related that his family resides at 116 Dennis Lane and they are requesting the rezoning to accommodate
the placement of a modular home or a double-wide on the property. He stated that the current residence on the property is in disrepair. They presented the Commission with photographs
of the current structure as well as several styles of modular homes for replacement of the current home.
With no one to speak in opposition to the request, Chairman Keaton closed the
public hearing at approximately 7:05 p.m.
City Engineer Whisker stated that the property is located directly across from Fire Station #4 on South Hwy. 161, adding that Reed’s Bridge
Battlefield owns the corner property on Dennis Lane across from this property. He noted that there is a C-1 zoned property for a

computer repair business, also located on Dennis Lane, that was
started approximately seven years ago. He explained that the Eptings are requesting to remove the existing home and replace it with a modular home. He related that a modular home is
different from a mobile home in that the construction meets house guidelines, while a mobile home only meets the guidelines of manufactured housing. He went on to say that there are
two separate zonings for modular homes versus mobile homes. He stated that the modular home would be set on a concrete foundation, adding that the house is already plumbed and has electrical.
In response to a question from Chairman Keaton, Mrs. Epting stated that they plan to demolish the old residence before having the new modular home setup on the property.
In response
to a question from Alderman Howard, City Engineer Whisker answered that there is not a conglomeration of zonings, but a conglomeration of uses prior to the area being zoned. He explained
that the property to the north had several mobile homes, but is currently down to one mobile home. He then related that another property had one mobile home that has now been removed.
He noted that there are two single-family homes in the area, and the computer business. He stated that the area is zoned R-1 except for this property. He then answered Commissioner
Moore that he does not feel that the property zoned C-1 is still being used for the operation of a computer repair business.
Commissioner Moore questioned having the C-1 property
rezoned to reflect single-family.
City Engineer Whisker noted that once the mobile homes are removed they would have to be replaced with single-family homes unless the owners requested
a different zoning. He then answered that the setback requirements would be 25’ front and rear; and 5’ for each side. He then related that the property is unplatted so Mr. Epting will
have to return to the Planning Commission with a site plan or go through the platting process, whichever the Planning Commission deems appropriate.
City Engineer Whisker explained
that “site plan approval” allows for construction on property that is defined by a metes and bounds description that was parceled out from a larger tract of land generally an older land
dividing practice. He then explained that platting is the creating of a formal subdivision where normally curb and gutter would be required as well as sidewalks and other improvements.
He went on to say that the property is given a subdivision name consisting of one or more lots. He recalled that the computer business property mentioned earlier created a one-lot
subdivision but was not required by the City to construct sidewalk,

and/or curb and gutter. He stated that the difference is the cost,
adding that plat process would require the property to be surveyed whereas with a metes and bounds the property owner can draw his plans showing the appropriate setbacks. He related
that mostly petitioners have been asked to plat their property but if the Commission feels this will be the only existing residence, sidewalks can be waived as well as other improvements.
He noted this is mostly the practice with subdivisions that have a culdesac of less than twenty lots. He stated that the Planning Commission will only require a final plat.
Commissioner
Moore moved, seconded by Commissioner Scholls to approve the rezoning of R-1 to R-5 at 116 Dennis Lane as requested. MOTION CARRIED.
City Attorney Bamburg noted that the rezoning
would go before the City Council on June 28th for their consideration.
