REGULAR PLANNING COMMISSION MEETING
DECEMBER 10, 2012
7:00 P.M. – 7:12 P.M.
OPENING REMARKS:
The Planning Commission of the City of Jacksonville, Arkansas met in
regular session on December, 2012. Chairman Keaton opened the meeting
at approximately 7:00 p.m. expressing appreciation to those in
attendance.
ROLL CALL: Commissioners Jon Johnson, Scott Scholl, Jim Moore, Joe
Cummings, Jr., Joe Ott, Eric McCleary, and Alderman Bill Howard
answered ROLL CALL. Chairman Keaton also answered roll call and
declared a quorum. PRESENT (8), ABSENT (1).
Others present for the meeting were City Attorney Bamburg, City
Engineer Jay Whisker, interested citizens, petitioners, and press.
Nomination for 2013 Planning Commission Chairman, Vice Chairman, and
volunteers for 2013 Board of Adjustment.
Commissioner Howard moved, seconded by Commissioner Ott to nominate
Glen Keaton as Planning Commission Chairman for 2013. MOTION CARRIED.
Commission Howard moved, seconded by Commission Scott to nominate Joe
Ott as Vice Chairman of the Planning Commission and Chairman to the
Board of Adjustment. MOTION CARRIED.
Commissioner Moore and Alderman Howard volunteered to serve on the
2013 Board of Adjustment.
CORRECTION AND/OR APPROVAL OF MINUTES:
Commissioner Ott moved, seconded by Commissioner Moore to approve the
minutes of the regularly scheduled Planning Commission meeting of 13
November 2012 as presented. MOTION CARRIED.
PUBLIC HEARING(S):
REQUEST TO APPROVE PLAT(S): REPLAT of lots 19 & 20 Jamestown
Subdivision to lots 19R & 20R Jamestown Subdivision
Mr. Tommy Bond of Bond Engineering explained that lots are located at
the corner of Puritan and Commons Drive, belonging to Dickie Jones. He
related that Mr. Jones constructed a building on the back of his lot,
adding that since he owned all the land, he did not pay attention to
lot lines. He stated that in order to correct that the lot has been
extended to be deeper than previous and the other lot adjacent was
redrawn to match. He continued saying that they are also proposing to
close an easement, which the City Council will have to act. He
explained that the easement was unused.
City Engineer Whisker noted that Mr. Jones would apply to the Board of
Adjustment for a variance regarding the front half foot of the
accessory building that is over the build line. He stated that once
this is approved it will clean up the situation.

Discussion ensued and City Attorney Bamburg clarified that any
approval would need to be contingent on the building line variance
being granted by the Board of Adjustment.
City Engineer Whisker stated that Mr. Jones is trying to get the
property into compliance so he can have it proper for sale.
Alderman Howard moved, seconded by Commissioner McCleary to approve
the Replat of Lots 19 & 20 to Lots 19R & 20R of Jamestown Subdivision.
MOTION CARRIED.
BUILDING PERMIT(S): SITE PLAN Landmark Baptist Church on Marshall Road
Mr. Tommy Bond pointed out that the site plan was tabled at the
October meeting, noting that the Planning Commission had requested
some changes to the site plan. He stated that the site plan being
presented incorporates those requested changes.
City Engineer Whisker concurred that the current site plan does
reflect the requested changes. He noted that the Church is trying to
move forward quickly because the lease on their building sold to the
Credit Union ends in March or May. He referred to the plat,
explaining that the road is on the north side of the property,
pointing out the parking areas as well as the Church on the south end
of the property. He then explained that the plan was shifted some,
noting that the parking lot to the west is an overflow parking lot and
the building pad to the east side of the parking lot will be the new
Church and the existing Church will become a gym. He then explained
that the sidewalk would be 3’ away from Marshall Road.
Commission Moore noted the location of the ditch, questioning if the
sidewalk would be on the other side of the ditch.
Mr. Bond stated that if there is enough room the sidewalk would be 3’
from the curb, adding that if there isn’t then they may have to go
onto the property out of the right-of-way to construct the sidewalk.
City Engineer Whisker clarified that the retention basin would be on
the north east corner of the property. He added that the landscape
plan will be forwarded. He clarified that the landscape plan will be
inside the island that makes an “I” shape in the middle of the parking
lot. He then answered Commissioner Moore, that he had explained to
the Church that waivers are not issued regarding curb and gutter and
all street improvements. He stated that the they have not requested a
waiver, noting that the only other way would be to bond with a letter
of credit for one year.
Commissioner Moore moved, seconded by Commissioner Johnson to approve
the site plan for Landmark Baptist Church on Marshall Road as
presented. MOTION CARRIED.
