0733 PAGE ~S ORDINANCE NO. 733 AN ORDINANCE TO LEVY AN ADDITIONAL COURT COST ON THOSE INDIVIDUALS WHO PLEAD GUILTY, NOLO CONTENDERE OR IS FOUND GUILTY OF DRIVING WHILE INTOXICATED OR DRIVING WHILE IMPAIRED IN THE CITY OF JACKSONVILLE; DECLARING AN EMERGENCY AND FOR OTHER PURPOSES. WHEREAS, the Arkansas General Assembly enacted Act 918 of 1983 which imposed additional court costs on individuals who plead guilty, nolo contendere or is found guilty of driving while intoxicated or driving while impaired and permitted a city which levied these costs to retain a certain sum for its use of the additional court costs: NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF JACKSONVILLE, ARKANSAS, THAT: Section 1: In accordance with Act 918 of 1983 of the Arkansas General Assembly, the City of Jacksonville does hereby levy upon any person who pleads guilty or nolo contendere or is found guilty of driving while intoxicated or driving while impaired, an additional court cost of two hundred and fifty dollars ($250.00). Section 2: For the fiscal year of 1982-1983 and during the 1983-1984 fiscal year the City of Jacksonville shall retain $75.00 of the $250.00 court costs imposed by Section 1 above for its own use and benefit. Section 3: For the fiscal year of 1984-1985 and thereafter, the City of Jacksonville shall retain for its use and benefit the sum of $100.00 of the $250'.00 court costs imposed by Section 1 above. Section 4: The remaining court costs not retained by the City of Jacksonville shall be despersed as provided in Act 918 of 1983. Section 5: The invalidity of any part of this Ordinance shall not invalidate any other part hereof. Section 6: All Ordinances and Resolutions, or parts thereof, in conflict with this Ordinance are hereby repealed. PAGE ~(...;, ORDINANCE NO. 7 ~ ~ PAGE 2 Section 7: It is ascertained and declared that the need to strengthen the punishment for driving while intoxicated or impaired is necessary for the preservation of the life, health, and property of the inhabitants of the City and that in order to protect its inhabitants, the court costs set forth in this Ordinance must be immediately, irnplemented in order to properly provide the needed protection. IT IS THEREFORE, declared that an emergency exists, that this Ordinance is necessary for the immediate preservation of the public peace, health, and safety, and that this Ordinance shall take effect and be in force from and immediately after its passage.
