0731 PAGE ( ( ORDINANCE NO. 731 AN ORDINANCE AMENDING ORDINANCE NO. 268 OF 1972, ORDINANCE NO. 350 OF 1975, AND ORDINANCE NO. 541 OF 1979, AS AMENDED BY ORDINANCE NO. 723 OF 1983 FOR SERVICES TO BE RENDERED BY THE SEWER SYSTEM OF THE CITY OF JACKSONVILLE, ARKANSAS; PRESCRIBING OTHER MATTERS RELATING THERETO; AND DECLARING AN EMERGENCY. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jacksonville, Arkansas: SECTION 1: Section 1 of Ordianance No. 723 is hereby amended to read as follows: "The following monthly rates and charges, which the City Council finds and declares to be fair, reasonable, and necessary minimum rates, are fixed as rates to be charged for sewer services to be rendered by the system, effective January 1, 1984: Monthly Sewer Rates. The monthly charge for each customer shall be determined each month by average monthly water consump- tion, and the amount to be paid by each customer shall be computed on the basis of the following schedule of rates: All Customers Except Air Base: First 2,000 gallons or part thereof Over 2,000 gallons $4.10 $1.43 per 1,000 gallons or part thereof The average monthly water consumption for each customer shall be determined on May 1 of each year or on the date the customer is first served by the waterworks, and shall be the average of the actual water consumption by that customer for the immediately preceding months of October through March. The average monthly water consumption for residential customers who were not served by the waterworks during the preceding months of October through May shall be deemed to be the average consumption of all residential customers. "Standard methods for examination of water and wastewater as published by the American Public Health Association shall be the so Ie and final determining factor as to the conformance, or failure thereof, of wastewater discharge. AIl such determinations shall be based on the discharge prior to its point of delivery to the public facilities without regard to flow, velocity, or dilu- tion existing in the public system at the point of discharge." SECTION 2: The invalidity of any part of this Ordinance shall not invalidate any other part hereof. PAGE 13 ORDINANCE NO. 731 PAGE THREE SECTION 3: All ordinances and resolutions, or parts thereof, in conflict with this Ordinance are hereby repealed. SECTION 4: It is ascertained and declared that the lack of an adequate sewer system for the needs of the City of Jacksonville, Arkansas, endangers the life, health, and property of the inhabitants of the City and that, in order to protect its inhabitants, the rates and charges set forth in this' Ordinance must be immediately implemented in order to assist in the finan- cing of construction of betterments, extensions, and improvements to the sewer system. IT IS, THEREFORE, declared that an emergency exists, that this Ordinance is necessary for the immediate pre- servation of the public peace, health, and safety, and that this Ordinance shall take effect and be in force from and immediately after its passage.
