0881 ~3 ORDINANCE NO. 8 8 1 (5-88) AN ORDINANCE AMENDING JACKSONVILLE MUNICIPAL CODE SECTION 6.04 (ANIMAL CONTROL), DECLARING AN EMERGENCY, AND FOR OTHER PURPOSES. WHEREAS, many citizens have expressed a concern about the need for additional animal control authority, specifically, those animals of a vicious nature running at large within the City of Jacksonville; and, WHEREAS, there is a need to deal specifically with dogs that have a propensity for viciousness in order to protect the health and safety of Jacksonville residents; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT: SECTION ONE: Jacksonville Municipal Code Section 6.04.010 (Definitions) shall be amended to include the following definition: 6.04.010 Stray Animal - Any animal which has been under the care of any person for more than fifteen (15) days shall become the property of said person for purposes of this Ordinance. SECTION TWO: Jacksonville Municipal Code Section 6.04.080 (Impoundment) shall be amended to include the following: 6.04.080 6. Notwithstanding any provision of this Code to the contrary, the Animal Control authority may humanely destroy any animal impounded in the animal shelter or left at the animal shelter at the rate of Ten and 00/100 Dollars ($10.00) per animal. No animals from outside the City limits shall be accepted for euthan- asiation, except in cases where it is necessary to prevent disease or injury to other animals or humans. SECTION THREE: Jacksonville Municipal Code Section 6.04.050 (Vicious Animal - Restraint) shall be amended to include the following: Vicious Animal - Restraint A. It is hereafter unlawful for any person, firm, or corpora- tion to keep within the corporate limits of the City any vicious animal unless it is muzzled, confined to a secure pen or any other enclosed area, or secured on a short leash or chain of sufficient strength to restrain the animal. B. All animals which are known to be or are suspected of having vicious propensities must be muzzled, confined to a secured pen or any other enclosed area, or secured on a short leash or chain of sufficient strength to restrain the animal to the owner's property. printed notices shall be conspicuously displayed whereby the same may be seen by persons passing in the vicinity where such animal is kept. C. In any case where an animal bites, molests, or injures or it is believed that the animal has bitten, molested or injured any person, or if said animal is discovered running at large and is suspected of being diseased, such animal shall be confiscated by the Animal Control authority, impounded in accordance with the provisions of this Code, and, if appropriate, humanely destroyed in accordance with the provisions of this Code. / tp1- SECTION FOUR: Jacksonville Municipal Code Section 6.04.120 shall be amended to include the following: D. The owner or keeper of any breed of animal with a propen- sity for viciousness as identified in the American Kennel Club and/or the united Kennel Club Breed Standards as having a propensity for viciousness which allows said animal to run at large or does not properly restrain said animal in accordance with the terms of this Code, shall be gui~ty of a misdemeanor and upon conviction shall be fined as follows: Licensed Animal Fine Unlicensed Animal Fine First violation Second violation Third violation Fourth violation Subsequent violations \~),l' $ 30 $ 75 $150 $300 $500 $ 40 $100 $ 200 $ 375 $600 plus $2.00 per day that animal is at Animal Shelter. No animal confiscated under this action shall be adopted by any person until such time as the accumulated fines and fees are paid. SECTION FIVE: All Ordinances or parts of Ordinances in conflict herewith are specifically repealed to the extent of such conflict. SECTION SIX: It is hereby ascertained and declared that an emergency exists and this Ordinance, being necessary for the immediate preservation of the public peace, health, and safety, shall take effect and be in force from and after its passage.
