0877 /.(1 ORDINANCE NO. 8 7 7 (#1-88) AN ORDINANCE AMENDING ORDINANCES NOS. 620 AND 684, SETTING FORTH REQUIREMENTS FOR CONTRIBUTORS TO THE JACKSONVILLE WASTEWATER COLLECTION AND TREATMENT SYSTEM; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES. WHEREAS, the Jacksonville Sewer Commission is required by federal law, 40 CFR 403, to establish and enforce limitations on the quantitites of specific pollutants which may be discharged to the local sewer system; and, WHEREAS, the Jacksonville Sewer Commission is granted authority by Municipal Ordinance No. 604 to regulate and monitor the use of the Wastewater Utility System; and, WHEREAS, the Jacksonville Sewer Commission has conducted a study to determine the allowable quantities of said pollutants within the Publicly Owned Treatment Works (POTW). NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT: SECTION ONE: Section One of Ordinance No. 684 is hereby amended to read as follows: Specific Pollutant Limitations No industrial user shall discharge wastewater of sufficient strength to cause the 24-hour loading to the POTW to exceed background levels by more than: 1.29 1.29 2.08 3.54 2.13 0.056 2.90 2.51 6.64 3.88 0.004 0.021 0.006 0.031 0.077 12.4 11.9 14.9 0.60 lbs/d arsenic lbs/d cadmium lbs/d copper lbs/d cyanide lbs/d lead lbs/d mercury lbs/d nickel lbs/d silver lbs/d total chromium lbs/d zinc lbs/d chlorophenol lbs/d 2,4-dichlorophenol lbs/d 2,6-dichlorophenol lbs/d 2,4,5-trichlorophenol lbs/d 2,4,6-trichlorophenol lbs/d phenol lbs/d 2,4-dichlorophenoxyacetic acid lbs/d 2,4,5-trichlorophenoxyacetic acid lbs/d 2, (2,4,5-trichlorophenoxy) propionic acid of 2,3,7,8-tetrachlorodibenzo-p-dioxin zero discharge The Jacksonville Sewer Commission shall be empowered to determine fair and equitable allocation and to establish specific limitations for the substances and quantities listed above to all users of the POTW through the permits issued in accordance with Ordinance No. 620. All permits issued under the conditions of this Ordinance shall comply with any and all State or Federal Standards and each permit holder acknowledges that more stringent State and Federal Standards shall be incorporated into permits as such standards are promulgated and become effective. SECTION TWO: If any provision, paragraph, word, section, or article of "this Ordinance is invalidated by any court of com- petent jurisdiction, the remaining provisions, paragraphs, words, sections, and chapters shall not be affected and shall continue in full force and effect. tJ'9 SECTION THREE: All Ordinances or parts of Ordinances in conflict herewith are specifically repealed to the extent of such conflict. SECTION 4: It is hereby ascertained and declared that an efficient and effective wastewater collection and treatment system can only be provided with proper enforcement of limitations on quantities of specific pollutants and that only by the passage of this Ordinance can such protection be guaranteed. It is, there- fore, declared that an emergency exists and this Ordinance, being necessary for the immediate preservation of the public peace, health, and safety, shall take effect and be in force from and after its passage.
