0875 I1'J ORDINANCE NO. 8 7 5 (#27-87) AN ORDINANCE DECLARING AN AGREEMENT BETWEEN THE CITY OF JACKSONVILLE AND PULASKI COUNTY, ARKANSAS, FOR THE PURPOSE OF HOUSING COUNTY PRISONERS IN CITY JAIL FACILITIES; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES. WHEREAS, Pulaski County has been unable to appropriate or raise funds to construct facilities large enough to house the numerous county prisoners; and, WHEREAS, to alleviate a portion of the burden on the County, they have requested that the political entities within the County provide housing for some of the County prisoners in order to alleviate the overcrowded conditions at the County facilities. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE THAT: SECTION ONE: The Chief of Police is hereby authorized to enter into an agreement with Pulaski County officials for the pur- pose of housing County prisoners at such times as are needed to assist in the reduction of the number of prisoners housed in County facilities. In exchange for said action, the agreement should specify that the City of Jacksonville will receive Twenty-five and 00/100 Dollars ($25.00) per day per prisoner with the Chief of Police to provide an accurate record of all County prisoners housed in the City jail facilities in a monthly report. Said report shall be turned over to the City Finance Department, which shall issue a statement on a monthly basis to the County officials. Such an agreement shall not obligate the City to house more than the maximum number of prisoners to be housed in our facili- ties and the City shall reserve the right to refuse to house County prisoners if it is necessary for the health, safety, and betterment of our community. SECTION TWO: That all Ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION THREE: It is, declared that an emergency exists because of the extreme necessity to eliminate the overcrowding of County prison facilities and this Ordinance, being necessary for the immediate preservation of the public peace, health, and safety, shall take effect and be in force from and after its passage.
