ORDINANCE NO. 8 7 2 (#24-87)
AN ORDINANCE AMENDING ORDINANCE NOS. 213 AND 838 TO PROVIDE
ADDITIONAL PROVISIONS REGARDING THE ERECTION, MAINTENANCE OR USE
OF OUTDOOR ADVERTISING DEVICES AND/OR SIGNS; DECLARING AN
EMERGENCY; AND OTHER PURPOSES.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION 1: Ordinance No. 838, Section III, A, Line 12,
shall be amended to read as follows:
"A clear line of vision will exist between three (3) feet
and eight (8) feet above the existing grade."
SECTION 2: Ordinance No. 838, Section III, Section B(l)(a),
Line 5, shall be amended to include the zone classification A-I
for areas in which billboards will be allowed.
SECTION 3: Ordinance No. 838, Section III, C(2)(b) shall
be amended to read as follows:
"An additional on-site free-standing sign of equal size
will be allowed provided it meets one of the following
criteria:
(i) A sign having a minimum clearance of five (5)
feet from a point three (3) feet above the ground to
the bottom of the sign shall be allowed to have the
leading edge of the sign even with the front property
line; or,
(ii) A sign that does not have a minimum clearance of
five (5) feet from a point three (3) feet above the
ground to the bottom of the sign must have a minimum
ten (10) feet set back from the front property line to
the leading edge of the sign."
SECTION 4: Ordinance No. 838, Section III, C(3)(b) shall
be amended to read as follows:
"An additional on-site free-standing sign not to exceed one
hundred (100) square feet, total, will be allowed provided:
(i) A sign having a minimum clearance of five (5)
feet from a point three (3) feet above the ground to
the bottom of the sign shall be allowed to have the
leading edge of the sign even with the front property
line; or,
(ii) A sign that does not have a minimum clearance of
five (5) feet from a point three (3) feet above the
ground to the bottom of the sign must have a minimum
ten (10) feet set back from the front property line to
the leading edge of the sign."
SECTION 5: Ordinance No. 838, Section III, C(4)(b) shall
be amended to read as follows:
"An additional on-site free-standing sign of two hundred
(200) square feet, total, will be allowed provided:
(i) A sign having a minimum clearance of five (5)
feet from a point three (3) feet above the ground to
the bottom of the sign shall be allowed to have the
leading edge of the sign even with the front property
line; or,

(ii) A sign that does not have a minimum clearance of
five (5) feet from a point three (3) feet above the
ground to the bottom of the sign must have a minimum
ten (10) feet set back from the front property line to
the leading edge of the sign."
SECTION 6: Ordinance No. 838, Section III, C(5)(b) shall
be amended to read as follows:
"An additional on-site free-standing sign of equal size
will be allowed provided:
(i) A sign having a minimum clearance of five (5)
feet from a point three (3) feet above the ground to
the bottom of the sign shall be allowed to have the
leading edge of the sign even with the front property
line; or,
(ii) A sign that does not have a minimum clearance of
five (5) feet from a point three (3) feet above the
ground to the bottom of the sign must have a minimum
ten (10) feet set back from the front property line to
the leading edge of the sign."
SECTION 7: Ordinance No. 838, Section IV, A(l) shall be
amended to include the following provisions:
"(d) There shall be no fee assessed nor a permit issued to
any existing sign previously approved by the Jacksonville
Planning Commission, Jacksonville Board of Adjustments, or
any other appropriate governing body prior to April 16, 1987.
(e) Any signs in existence prior to April 16, 1987, shall
be accepted as a conforming sign for purposes of this
Ordinance for as long as said sign does not constitute a
health or safety hazard or until said sign falls into a
state of disrepair. In the event any such sign is sold or
transferred, said conforming sign status shall be trans-
ferred as long as a fee is paid to the City (as required by
the zoning classification) and the sign remains in a state
of proper repair."
SECTION 8: Any Ordinance or parts of any Ordinance in
conflict herewith is specifically repealed to the extent of such
conflict.
SECTION 9: It is ascertained and declared that it is
necessary for the public health and safety to implement the above
mentioned provisions for the needs of the City of Jacksonville,
Arkansas, in order to protect its inhabitants. It is, therefore,
declared that an emergency exists, that this Ordinance is
necessary for the immediate preservation of the public peace,
health, and safety, and that this Ordinance shall take effect and
be in force from and after its passage.
