0863 /~7 ORDINANCE NO. 863 (~~~87l AN ORDINANCE REQUIRING THE BUILDING AND MAINTAINING OF A FENCE AROUND SWIMMING POOLS WITHIN THE CITY LIMITS OF JACKSONVILLE; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES. WHEREAS, there is a danger to the public health, safety and welfare to have swimming pools without fences around them; and, WHEREAS, it is necessary to require fencing around swimming pools within the city limits, to avoid persons falling into said pools; therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT: SECTION 1. All swimming pools in the City of Jacksonville must have a fence at least four feet (4') high around the swim- ming pool to prohibit the access of the general public from said swimming pool. SECTION 2. A violation of this Ordinance shall constitute a misdemeanor and anyone convicted of maintaining a swimming pool without a fence shall be fined no less than One Hundred and 00/100 Dollars ($100.00) and no more than Five Hundred and 00/100 Dollars ($500.00). Each day the person(s) maintains the pool without the fence constitutes a separate offense. SECTION_~. It is hereby found that maintaining swimming pools without a fence around them constitutes a danger to persons within the city limits of Jacksonville. Therefore, an emergency is declared to exist, and this Ordinance being necessary for the preservation and advancement of the public peace, health, and safety shall be in full force and effect from and after its passage. SECTION 4. All Ordinances and parts of Ordinances in conflict with-'~t-he provisions of this Ordinance are hereby repealed. APPROVED THIS DAY OF AUGUST, 1987.
